1. Acceptance of Terms
By accessing this website or engaging the services of Sueste Creative, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you should refrain from using our services.
2. Services Provided
Sueste Creative provides web design, web development, visual identity and branding, social media management, drone video and photography, and digital marketing services. The exact scope of each project is defined in a proposal or specific agreement reached with the client before work begins.
3. Quotes and Proposals
Estimates generated through the website calculator are indicative only. The final price is set in a formal proposal after detailed analysis of the client's needs. Quotes are valid for 30 days from the date of issue.
4. Payment Terms
The standard payment structure is as follows:
- 50% upfront: upon acceptance of the proposal, before work begins.
- 50% on final delivery: upon client approval and before transfer of final files or publication.
Alternative payment terms may be agreed in writing. Payments can be made by bank transfer or other agreed methods. In the event of late payment, Sueste Creative reserves the right to suspend delivery or publication of the project.
5. Cancellation and Refunds
If the client cancels after work has begun, the initial deposit (50%) is generally retained to cover work already completed and resources allocated.
We recognise that exceptional circumstances may arise. In duly justified cases, we assess each situation individually and may agree a partial refund proportional to work not yet carried out. All refund decisions are communicated in writing.
Sueste Creative also reserves the right to cancel a project in the event of material breach by the client, retaining the value corresponding to work already completed.
6. Intellectual Property and File Delivery
Upon full settlement of the agreed amount, the client acquires full ownership of all final deliverables produced specifically for their project (designs, source code, content).
Sueste Creative retains:
- The right to present the work in its portfolio and marketing materials, unless otherwise agreed in writing.
- Ownership of any internal tools, frameworks, reusable components or methodologies used in the development.
Third-party elements incorporated in the project (commercial fonts, plugins, stock photography) are subject to their respective licences, which are communicated to the client. The transfer or sub-licensing of such elements is the client's responsibility after delivery.
7. Client Responsibilities
To ensure the smooth progress of the project, the client undertakes to:
- Provide the necessary content, materials and feedback in a timely manner.
- Designate a responsible contact person for approvals.
- Ensure they hold the necessary rights over all content provided (text, images, trademarks, etc.).
- Make payments on the agreed dates.
Delays caused by the client may result in postponement of agreed delivery dates, without liability on the part of Sueste Creative.
8. Subcontracting
Sueste Creative may engage external partners and collaborators (such as photographers, videographers or other creative specialists) for specific components of a project. Sueste Creative retains responsibility for coordination and the quality of work delivered, regardless of who carries it out.
9. Limitation of Liability
Sueste Creative shall not be liable for indirect damages, loss of profits or data loss resulting from the use of, or inability to use, the services provided. Sueste Creative's total liability to the client shall not exceed the amount paid for the project in question.
10. Confidentiality
Both parties undertake to keep confidential any commercial and technical information exchanged in the course of the working relationship, and not to disclose it to third parties without prior written consent, except where required by law.
11. Use of the Website
Use of this website is permitted only for lawful purposes. Any use that could damage, disable or overload our infrastructure, or that violates third-party rights, is prohibited.
12. Governing Law and Dispute Resolution
These terms are governed by Portuguese law. In the event of a dispute, the parties agree to seek an amicable resolution. In the absence of agreement, the dispute shall be submitted to the exclusive jurisdiction of the competent Portuguese courts.
